Premium Processing Now Available for All Petitioners Seeking H-1B Visas

On the 3rd of October 2017 U.S. Citizenship And Immigration Services (USCIS) resumed premium processing for all types H-1B visa extension of stay petitions.

H-1B Work Visa is designed and issued for professional workers on specialized careers and allows to work and live in the U.S. permanently for a certain period of time.

What is Premium Processing Service?

It is a 15-calendar day processing time guaranteed by USCIS. It will begin when USCIS receives the current version of Form I-907, Request for Premium Processing Service, at the correct filing address noted on the form. Within this 15-day period USCIS will issue an approval notice, a denial notice, a notice of intent to deny, a request for evidence or open an investigation for fraud or misrepresentation.

As the petitioner or its attorney or representative, you must complete and sign Form I-907, Request for Premium Processing Service, in accordance with the instructions on the current version of the form.

What if the Premium Processing time was not met?

USCIS will refund the premium processing service fee, and continue with the expedited processing of the case.

Who is eligible for Premium Processing Service?

Form I-129, Petition for Nonimmigrant Worker

  • Treaty trader
  • Treaty Investor
  • Alien in Specialty Occupation
  • Temporary Worker performing nonagricultural services
  • Trainee or Special Education Exchange Visitor
  • Intracompany Transferee, Executive or Manager Capacity
  • Intracompany Transferee, Specialized Knowledge Professional
  • A petitioner meeting certain requirements which seeks continuous approval of itself and some or all of its parents, branches, subsidiaries, and affiliates
  • Alien of extraordinary ability or achievements in the sciences, arts, education, business, or athletics
  • Alien providing essential support services for a principal O-1 alien
  • Internationally recognized athlete or member of an internationally recognized entertainment group
  • Essential Support Alien, highly skilled, who performs support services essential to the successful performance of the principal P-1 alien
  • Artist or Entertainer under a Reciprocal Exchange Program
  • Essential Support Alien, highly skilled, who performs support services essential to the successful performance of the principal P-2 alien
  • Artist or Entertainer in a Culturally Unique Program
  • Essential Support Alien, highly skilled, who performs support services essential to the successful performance of the principal P-3 alien
  • International cultural exchange alien
  • Alien in a Religious occupation
  • NAFTA professional, Canada
  • NAFTA professional, Mexico

How to file a request for Premium Processing Service?

As the petitioner or its attorney or representative, you must complete and sign Form I-907, Request for Premium Processing Service, in accordance with the instructions on the current version of the form.

Within this 15-day period USCIS will issue an approval notice, a denial notice, a notice of intent to deny, a request for evidence or open an investigation for fraud or misrepresentation.

Note

USCIS will reject any Form I-907 Premium Processing Service requests that are filed at an office without geographic jurisdiction over the underlying petition if the Form I-907 is filed:

  • concurrently with a Form I-140 petition;
  • concurrently with a Form I-129 petition; or
  • as a standalone relating to a Form I-129 petition.
